GENERAL RENTAL CONDITIONS
The lessor rents to the lessee, for a fixed period, the vehicle described on the front of this contract under the terms and conditions stipulated below. The lessee accepts these terms and conditions by signing. The lessee is responsible for the vehicle for the entire rental period, from the time of pickup until the return to the lessor.
Article 1: DELIVERY AND RETURN
The lessee acknowledges that the vehicle is operational and in good general condition (including all documents).
The lessee agrees to return the vehicle to the lessor with all its accessories and documents, in the same condition as it was delivered, at the location and time specified in the contract. The final condition is assessed by the lessor or any person authorized by them upon return.
Unless expressly authorized by the lessor, failure to return the vehicle on the scheduled date may be considered a breach of trust, exposing the lessee to legal action. In such cases, the lessor may retrieve the vehicle at the lessee’s expense and risk, after informing the authorities.
In the event of an unresolved dispute, it will be settled by the summary judge of the Rabat Court of First Instance.
Article 2: USE OF THE VEHICLE
The rental contract is personal and non-transferable.
Drivers of the vehicle must meet the age and license requirements specified in the current rates at the time of rental. These drivers act as representatives of the lessee.The lessee agrees to use the vehicle only on authorized roads.
The lessee agrees not to tow or push another vehicle or trailer, not to modify the vehicle in any way, and to use the locking and security systems each time it is parked, keeping the keys and vehicle documents on them.
In the event of tire damage for reasons other than normal wear, the lessee agrees to repair or replace them immediately with tires of the same dimensions and characteristics.
Article 3: RENTAL PRICE AND PAYMENT
The lessee agrees to pay or reimburse the lessor, upon request, the following charges:
Time and mileage charges calculated based on the rate shown on the front of the contract or current rates. Mileage is determined by the vehicle’s manufacturer-installed odometer. If tampered with, a flat rate of 500 km/day will be applied.
All fuel charges, excess waiver fees, insurance for transported persons, accidents, and other charges stated on the contract or in current rates.
Costs for repairs of damage to the vehicle not caused by normal wear and tear, unless covered by optional damage waivers.
All applicable taxes and levies on the charges listed above.
All fines, penalties, or infractions incurred during the rental.
All collection fees for unpaid amounts due under this contract.
Costs for emergency repairs due to lessee negligence.
Claims handling fees even in non-fault accidents.
The security deposit given at vehicle pickup is used to cover any contract-related costs and is refundable within 15 days after vehicle check, by CHAS CAR.
Article 4: INSURANCE
The lessee and the vehicle are insured under the general conditions of the policies contracted by CHAS CAR, which can be reviewed at the lessor’s office:
The insurance covers material damage and liability during the rental period, under Moroccan road laws.
Coverage is valid only for the rental duration specified in the policy. Any use beyond this time without extension is not covered.
Subrogation rights: the insurance company may seek reimbursement from the lessee if:
The deductible is not paid;
Damages are not reported within 24 hours.
The deductible applies in case of theft unless otherwise agreed.
Optional guarantees: the lessee may pay an additional fee to reduce or remove the deductible and benefit from additional services like after-sales support.
Deductible surcharge currently set at 20%.
Optional insurance for transported persons.
In the absence of these options, the lessee remains fully liable, especially if the driver was under the influence of alcohol, drugs, or medication that impairs driving.
Obligation in case of an accident:
Immediately inform the lessor and submit a report within 24h;
Notify CHAS CAR of all details, even in minor or no-injury accidents.
The report must include date, time, location, witnesses, and may require a police or bailiff report.
The lessee may not negotiate or settle with third parties without the written authorization of the lessor and must provide all necessary documents and information.
Article 5: VEHICLE DOCUMENTS
The lessee must return all vehicle documents at the end of the rental.
In case of loss or destruction, the lessee must provide a loss certificate and pay a fee set by the lessor.
Article 6: LIABILITY
The lessee is solely responsible for all fines, violations, and tickets issued during the rental.
If the vehicle is seized by authorities, all costs are at the lessee’s expense.
Article 7: JURISDICTION
In the event of a dispute regarding this contract, jurisdiction is granted to the courts of Rabat.
